I – DOCUMENTS NEEDED TO BE LICENSED FOR CONSTRUCTION:

Applicants for construction permits must have one of the following documents:

  • Land use right certificate (Red certificate), if building a house on bare land.
  • Certificate of land use right and land use right certificate (Pink certificate) or certificate of house ownership, if making house on old floor.
  • Decision on land allocation and land lease by the competent State agencies.
  • The temporary land use right certificate was issued by the competent authority or included in the cadastral book without any dispute.
  • Documents issued by competent agencies under the former regime (including: Land title or Excerpt, Land copy, Land copy map, Land plot division map, Certificate of everlasting visa, birth registration, title transfer) at the Attorney General’s Office, Ty Dien Dien, Nha Registration).
  • The certificate of inheritance of house and land is certified by the People’s Committee of the commune and ward on inheritance without any dispute.
  • The legally effective judgment or decision of the People’s Court or the decision on land dispute resolution.
  • Documents on land transfer, house purchase and sale together with residential land use rights are certified without any dispute by the People’s Committee of Ward / Commune / Town, District / District.
  • Valid papers on housing and residential land according to Decision No. 38/2000 / QD-UB-DT of June 19, 2000 of the City People’s Committee.

II. DOSSIERS OF APPLICATION FOR GRANTING NEW LICENSE LICENSES:

A dossier of application for a new construction permit, made in 3 sets and submitted to the District People’s Committee, comprises:

  • An application for a construction permit (made according to a set form) in the name of the owner.
  • A certified copy of one of the land use rights papers, attached with an extract of the land map or an on-site measurement that identifies the plot map of the land lot, elevation and scale in accordance with cadastral regulations.
  • Business registration license (if the enterprise is a construction project).
  • Design documents include: Construction ground on the land lot of 1 / 200-1 / 500 scale, work location map, floor plans, vertical sections and sectional works of 1/100 scale, ground foundation, cross-sectional details, water supply and drainage scheme.

III – AUTHORITIES AUTHORIZING CONSTRUCTION LICENSE:

The Chairman of the District People’s Committee grants permission to build houses and constructions with floor area of up to 1,000m2 or an investment of up to VND 2 billion, larger works are licensed by the City Department of Construction.

The maximum period of construction permit is 30 days after receiving complete and valid dossiers. After 30 days, without a permit or a refusal from the licensing agency, the permit applicant shall make an application to the People’s Committee of Ward and be entitled to start the construction without a permit.

IV – PLEASE EXTEND THE CONSTRUCTION LICENSE:

Within 12 months from the date of obtaining the construction permit but the work has not yet started, the applicant shall be granted an extension, the additional time limit is 12 months. An application for extension includes:

  • Application for extension of construction permit (form)
  • The original of a construction permit issued.

V- PROCEDURE FOR COMPLETION IS PROVIDED:

After construction is completed, the landlord must submit a completed application. The licensing authority is also the agency that completes the record of the completion. The completed dossier includes:

  • Notice of inspection of completed works (according to set form).
  • Copy of construction permit.
  • A copy of the construction contract with a contractor with legal status (with a visa).

VI-PLEASE LICENSE FOR REPAIRING AND EXPANDING PRIVATE INDIVIDUAL HOUSING:

A dossier of application for a repair permit is made in 3 sets and submitted to the District People’s Committee, including:

  • An application for a construction permit (made according to a set form) in the name of the owner.
  • A certified copy of one of the documents on land use rights and house ownership (if any) together with an extract of the land map or an on-site measurement identifying the land plot outline map, elevation and The ratio is right up to the cadastral regulations.
  • Business registration license (if the enterprise is a construction project).
  • Design documents include:
